Summary Judgment Granted to Defendants In Reglan Case
A judge has granted summary judgment against Schwartz Pharma (now UCB Inc.) and others, agreeing that an Ohio statute barred a plaintiff from seeking recovery from brand name drug manufacturers after she took the generic equivalent of the drug. The plaintiff’s Reglan lawyer tried to make the case that the statue preventing such recovery did not apply to the plaintiff’s claims; however, the judge rejected the argument. The ruling may have a bearing on the outcome of future Reglan lawsuits. Though there are numerous Reglan cases pending in courts across the country, there has been no Reglan class action lawsuit filed at this time.
